CAN’T GIVE LEGAL ADVICE
Certified document preparers aren’t attorneys. They can’t provide any legal advice. They can’t ensure that you preserve all potential claims. They can’t ensure that you don’t waive any affirmative defenses. They can’t advise you when a different strategy exists to better achieve your legal objectives.
MISTAKES CAN BE IRREVERSIBLE
A mistake in your pleadings can permanently waive certain claims or defenses. It can forfeit legal rights or entitlements. As an example, in a recent divorce we litigated, the opposing party hired a certified document preparer to prepare her petition for dissolution. The document preparer failed to request equalization of property in which the opposing party would have had a financial interest. Ultimately, this mistake cost the opposing party thousands of dollars.
Most people go to document preparers instead of attorneys because they want to save money. Well, from our experience, document preparers are actually pretty expensive for the limited assistance they can provide.
