This child custody case had a long procedural history, as many do. After the parties divorced, the Mother attempted to modify child custody several times; ultimately hoping to completely exclude Father from the children’s lives. Father believed Mother’s goal was to manipulate child support because as his parenting time decreased, his child support obligation increased.
Mother’s allegations against Father continuously escalated until she eventually alleged that Father physically and sexually abused the children. She retained one of the most prominent family law firms in Phoenix to obtain emergency temporary orders that completely suspended Father’s parenting time. She also reported these allegations of abuse to DCS, formerly CPS, and local law enforcement.
Father, who was previously represented by a family lawyer, sought the assistance of our Scottsdale child custody lawyers based on our litigation experience. Immediately, we devised a comprehensive strategy to discredit Mother and her witnesses, including an expert witness who conducted a forensic interview of the children. During cross examination of the interviewer, we cited academic and empirical standards that undermined the interviewer’s opinion and forced the interviewer to admit that the children were coached, likely by Mother. Likewise, Mother’s allegations imploded on cross examination.
In closing, we asked the family law judge to restore Father’s parental rights and to sanction Mother for her false allegations. In its Ruling, the family court reinstated Father’s parenting time and legal decision-making rights and ordered Mother to pay all of Father’s attorney’s fees incurred during the litigation.
